Contentious Insolvency specialist joins Opus

June 3, 2021

Throughout the pandemic, most businesses have been able to ride the storm due to support through the Government’s various emergency financial and legislative measures. As this protection is withdrawn, businesses will be under pressure to address overdue debt and run financially viable companies. Times of pressure and economic crisis often lead to contentious issues such as potential preference payments, transactions at an undervalue/defrauding creditors, void dispositions, illegal dividends, breach of contract/warranty issues and misfeasance. These issues are often only identified once a company enters an insolvency process and require expertise in fraud, contentious insolvency and forensics.

Andrew Foster, a Contentious Insolvency specialist, with a proven track record of making recoveries for insolvent estates joins Opus as Head of Investigations & Contentious Insolvency. He will be working closely with its Restructuring & Insolvency and Forensic Accounting divisions. Andrew brings a wealth of experience with him and continued success in bringing claims against company directors and third parties.  Andrew is also experienced in obtaining interim relief remedies, including worldwide freezing injunction orders.

With a background in fraud investigations, Andrew started his career at the Serious Fraud Office before joining the Insolvency Service as a dedicated investigator.  Following his move from the public sector to private practice, Andrew has spent the past nine years successfully identifying and litigating complex claims on behalf of creditors.

Andrew said,

“I am excited to join Opus and grow the team. We will be working closely with creditors, producing investigation reports for solicitors and Counsel and providing instructions pursuant to contentious issues. The structure and support network within the Group is extensive and was a key reason for joining Opus. Growing my team with this backing will ensure that we can efficiently deliver the work we undertake.”

Steve Parker, Partner at Opus concludes,

“As a Group, we are on a steep growth trajectory and developing this area of the business is integral to our objectives and ambitions. Andrew brings a vast amount of experience in managing and directing the workload of investigation staff in both the private and public sectors. Andrew is a fantastic fit for Opus. We are delighted to have him on board and look forward very much to working with him.”
